A Metropolitan Magistrate court in Mumbai granted bail to businessman Raj Kundra in the porn racket case. It observed in its detailed order that the prime ingredient of cheating appears to be missing from the case.

Chief Metropolitan Magistrate SB Bhajpale passed the order after perusing the chargesheet filed by the Mumbai police which was more than 400 pages long. According to the chargesheet, about 64 witnesses have been cited by the prosecution. The (IO) investigating officer had recorded statements of the witnesses under section 164 of the Code of Criminal Procedure.
The Magistrate found that all the other accused who were arrested were already released on bail. Therefore, there was no reason to keep the accused Kundra behind bars till the conclusion of trial. Raj Kundra had to furnish security for his appearance and to abide by the conditions imposed by the court. He cannot leave India without the prior permission of the court, will not tamper with evidence and keep the police informed if there is any change in his residential address or contact number.
