High Court dismisses PIL

The Madras High Court dismissed a Public Interest Litigation filed by an advocate seeking for a direction to the Secretary of the President of India from giving effect to the transfer proposal of CJ Tahilramani.
A Division Bench comprising of Justices M Sathyanarayanan and N.Seshasayee rejected the petition on the ground that the decision of transfer was taken by the Collegium of the Supreme Court comprising of the Chief Justice and four senior most judges of the Supreme Court. Justice Tahilramani  had submitted her resignation which was accepted by the President and Justice Vineet Kothari who is the senior most judge of the Madras High Court had been appointed as the Acting Chief Justice by a notification dated 20th September 2019. In the light of the above facts, it dismissed the Public Interest Litigation as not maintainable.
