Supreme Court rejects divorce plea of 89 year old man

0

The Supreme Court recently rejected a plea from an 89 year old senior citizen who sought to divorce his 82 year old wife. A Division Bench of the Court comprising Justices Aniruddha Bose and Bala M Trivedi observed that ”irretrievable breakdown of marriage” cannot be considered a straightjacket formula to always grant divorce.

They also held that despite the rise in divorce cases, marriage is still considered to be a pious institution in India. In this case, the wife expressed her willingness to live with her husband and even to look after him and did not wish to live with the stigma attached to a divorcee.
The Court held that if divorce was granted in this case, it would amount to an injustice to the wife.
The district court allowed the divorce petition of the husband and the Punjab and Haryana High Court set aside the order of the district court and therefore the husband had appealed to the Supreme Court.

Women judges in Kerala can wear outfits other than sarees to court

0

Women judges in Kerala have the freedom to wear outfits other than sarees to court. They can now wear long skirts, churidars and full sleeves shirts and pants but it has to be in the black and white combination.

The Kerala High Court last week cleared a request from women judges allowing them to wear modern dresses in courts. The more than half a century old dress code has been modified.
Women found it difficult and uncomfortable to wear sarees in the hot and humid climate in poorly ventilated chambers and packed court halls. The frequent power disruptions added to their woes. This old fashioned dress code was taking a toll on their health especially in the summer season.
The High Court had appointed a committee of judges to look into the representation. They prepared a report which was placed before the Administrative Committee and later at a Full Court meeting. The Chief Justice of Kerala made a formal announcement on the modified dress code at a meeting of the Judicial Officers Association on October 8.
