The Samastha Kerala Jamiathul, one of the biggest religious organisations of Sunni Muslims has challenged the constitutionality of the triple talaq law by filing a case in the Supreme Court on Friday. According to them, the only objective of the Act was to punish Muslim husbands. The Act not only makes triple talaq as a penal offence, it also imposes a maximum sentence of imprisonment upto 3 years. The offence has further been made cognizable and non- bailable.

They felt that if the motive of the Act was to protect a Muslim wife, no purpose would be served if an errant husband is put behind bars. They further said that the Supreme Court had already declared that triple talaq was null and void and that the marriage would continue to exist in spite of the utterance, there was no logic behind the government making it an offence now.
