Madras HC judge visits litigant’s bed-ridden father at his home

Justice GR Swaminathan took his wife Kamakshi who is a special educator and has experience dealing with mentally ill people to visit a bed-ridden father of a litigant at his home to ascertain his mental condition.

The judge decided to visit the 83 year old man at his residence in Kodambakkam in Chennai. The octogenarian suffered a stroke in 2021 and lost his ability to speak. He has been fed through a tube since then.
In this case, Sivakumar Chellathurai filed a petition to appoint him as manager of his father PKM Durai’ properties and to dispose them.as well. He also filed a sub-application to direct his mother and youngest brother to admit his father in hospital and asserted that his father was mentally ill.
When the judge visited his home, he was shown two papers with the words home and hospital. The octogenarian touched the word home. He had a detailed discussion with the younger brother of the applicant.
The petition filed by the applicant was held as not maintainable as there were no merits in it.
