Supreme Court to hear case on adultery

A five judge Constitution Bench headed by Chief Justice of India Dipak Mishra began to examine if the provision of adultery in Section 497 of IPC violates the constitutional concept of gender equality. A petition was filed to drop the provision from the IPC.

The Bench will re- examine a view dating back to 1954 if adultery should be retained in the Penal Code.Section 497 provides that if a married man has sexual intercourse with another man’s wife without the husband’s consent or connivance, he is guilty of adultery and is liable to be punished. This provision does not provide the wife a right to prosecute her husband for adultery.
