A five judge Constitution Bench of the Supreme Court will reconsider the legal validity of the 157 year old adultery law in the Indian Penal Code where only a man and not a married woman is punishable for adultery. The provision was held to be archaic and the section required to be reconsidered taking into account societal progress, outlook, gender equality and gender sensitivity.

Under the current provision in the IPC, only the man will face punishment for adultery while the woman is let off considering her to be a victim. The Supreme Court felt very strongly that the provision and the earlier Supreme Court judgments upholding it would have to be reconsidered.
