Live in relationship of teens held valid

The Kerala High Court upheld the right of a 18 year old youth and a 19 year old girl to live together as majors have an unfettered right to have a live in relationship even though society looks down upon it. The Division Bench dismissed the habeas corpus petition filed by the father of the girl to produce his daughter.

The Court held that the youth had not completed 21 years of age and hence there could not be a valid marriage between them. Moreover as the girl had the capacity to marry under section 251 of the Mohammedan law, she had every right to live with the youth even outside wedlock as live in relationships were statutorily recognized by the legislature under the Protection of Women from Domestic Violence Act, 2005.
