J.Deepa niece of former Chief Minister Jayalalithaa moved the High Court with a writ petition challengingly the State governments decision to convert the Poes Garden residence into a memorial. She claimed that the property devolved on her and her brother Deepak as per the Hindu Succession Act.She stated that her paternal grandmother purchased several properties in and around Chennai leaving behind her son Jayakumar and daughter Jayalalithaa. She contended that her father predeceased Jayalalithaa and she and her brother were second class heirs left behind to succeed to the property which included the Poes Garden residence.

She also contended that the Chief Minister had no locus standi  to issue a press release regarding conversion of the said property into a memorial.
The present writ was filed to restrain the government from issuing any press releases or from making any alterations at the Poes Garden residence.
