Children cannot be detained by police

The Supreme Court has made it clear that children cannot be detained by the police in lockup or jail. Any juveniles who are in conflict with law, have to be immediately placed under the care of the special juvenile police unit or a designated child welfare officer. Only after that the  child should be produced before the Juvenile Justice Board.
After that, the child should be granted bail. If bail is not granted, the child cannot be put behind bars but should be lodged in an observatory home. The Supreme Court delivered an 8 page judgment after it’s attention was drawn to media reports of children being detained and tortured in police custody in Delhi and in Uttar Pradesh in connection with protests under the Citizenship (Amendment) Act. The Court also issued notices to Delhi and Uttar Pradesh Commissions for Protection of Child Rights. They have been directed to file their counter within a period of 3 weeks.
